Client Agreement & Disclosure Statement
This document sets out the services FYN Limited will provide to you, including important information you should know before obtaining financial advice from us.
Important: Please read this document carefully before engaging our services. It forms part of your agreement with FYN Limited.
1. About Your Financial Advice Provider
FYN Limited (FSP1009679) holds a Financial Advice Provider (FAP) licence issued by the Financial Markets Authority (FMA) to provide financial advice under the Financial Markets Conduct Act 2013.

3. Nature and Scope of Advice
FYN Limited provides financial advice relating to personal and business lending and credit-related insurance products. We are able to provide advice about products available from the following providers:

We do not provide financial or other advice in the following areas, but we can refer you to a specialist adviser if you wish:

- Life, Disability and Health Insurance
- Fire and General Insurance
- Investments
5. How We Are Paid for Our Advice
Personal & Business Loans
For all lending, we charge a broker fee which will range from $350 – $2,500, or up to 10% of the loan amount. The level of fee charged will depend on the loan size and the complexity of the loan. The fee is payable from the loan amount at settlement.
We will also receive commission of either up to 5% of the loan amount or up to 6% as interest commission, depending on the lender.
Insurance
We receive commissions from the relevant insurance company if you take out credit-related insurance associated with your loan. The commissions are up to 50% of the premium of your policy. The amount depends on which insurance company and which insurance policy you choose.
6. How We Manage Conflicts of Interest
We have an obligation to prioritise your interests when making a recommendation. We have identified the following potential conflicts of interest:
Product Provider Commission
If you accept and act on our advice, we will receive a commission from the lender or insurer. Conversely, if you do not accept our advice, we will not receive a commission.
To ensure we prioritise your interests above our own, we follow an advice process that ensures our recommendations are made on the basis of your individual goals and circumstances. Specifically:
- We complete annual training on how to appropriately manage conflicts of interest
- FYN Limited and/or the lender undertake compliance reviews of our advice process
- FYN Limited engages an independent compliance consultancy firm to conduct ongoing independent compliance reviews and audits
7. Complaints and Disputes
If you have a complaint or dispute about the financial advice or services provided by FYN Limited, please contact us in the first instance:
If we are unable to resolve your complaint to your satisfaction, you may refer your complaint to our disputes resolution scheme or the Financial Markets Authority. Details of our disputes resolution scheme are available on our website.
8. How We Collect, Use and Share Your Information
FYN Limited complies with the Privacy Act 2020. In order to assemble your loan application and determine your eligibility for a loan and/or insurance product, we will require certain personal and financial information from you.
By engaging with us, you consent to us collecting information directly from you and, where necessary, from third parties, in accordance with this agreement and our Privacy Policy.
The information will be made available to FYN Limited, your Financial Adviser, the product provider, and any other necessary third parties in relation to implementing the advice.
Your information may also be disclosed to:
- Professionals such as solicitors or accountants, when a referral is made at your request
- Credit reporting agencies and any third party making an authorised enquiry about you
- Any prospective purchaser of our business, if we intend to sell
- The Financial Markets Authority, disputes resolution scheme, and/or independent compliance reviewer as required
- Our Professional Indemnity insurer in the event of a complaint
- Lawyers and other professionals in connection with defending or enforcing our legal rights
- Other financial institutions, at your request, if you seek products or services from them
- Government agencies where required by law (e.g. under Court Orders or statutory notices)
Your information is retained for a minimum of seven (7) years after your engagement has completed, as required by law.
This section explains our obligations under Information Privacy Principle 3A (IPP3A) of the Privacy Act 2020, which governs the collection of your personal information from sources other than yourself.
9. Indirect Collection of Personal Information (IPP3A)
From 1 May 2026, if FYN collects any of your personal information from someone other than you — for example, from a product provider, another adviser, or a third-party service provider — we are required under Information Privacy Principle 3A (IPP3A) to take reasonable steps to let you know that this information has been collected.
When Indirect Collection May Occur
Indirect collection may occur, for example, when:
- Verifying your identity for AML/CFT compliance purposes
- Collecting information from product providers as part of your application
- Working with your other professional advisers (e.g. accountant, solicitor)
- Obtaining credit reports from credit reporting agencies
What We Will Tell You
When indirect collection occurs, we will notify you of:
- That we have collected information about you
- The purpose for collecting it
- Who the intended recipients are
- The name and address of the agency collecting and holding the information
- Whether the collection is required or authorised by law
- Your right to access and correct your information
How and When We Will Notify You
We will provide this notification as soon as reasonably practicable after the information is collected, unless an exception under the Privacy Act applies. Notification will be by email, letter, or another reasonable method depending on the circumstances.
10. Client Acknowledgements
By engaging FYN Limited's services, you confirm and declare to the Financial Advice Provider, the product provider, and any other information recipients that:
- The information you provide in your application is true and correct
- Where your Financial Adviser has assisted you to complete your application, you have authorised this and the information provided is true and correct
- You understand that your Financial Advice Provider is required to keep your information for a minimum of seven (7) years after your engagement has completed
- You understand how your information may be collected, used, stored, and shared
- The advice process has been explained to you, you have agreed the type of advice that will be given, and you acknowledge that broker fees will apply
- You have been informed how to access the FYN Privacy Policy
